James O’Keefe’s people pull more felony-level shenanigans:
It was one of the few — if not the only — coordinated efforts to attempt in-person voter fraud, and it was pulled off by affiliates of conservative activist James O’Keefe at polling places in New Hampshire Tuesday night. All of it part of an attempt to prove the need for voter ID laws that voting rights experts say have a unfair impact on minority voters.
Now election law experts tell TPM that O’Keefe’s allies could face criminal charges on both the federal and state level for procuring ballots under false names, and that his undercover sting doesn’t demonstrate a need for voter ID laws at all. Federal law bans not only the casting of, but the “procurement” of ballots “that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held.”
Hamline University law professor David Schultz told TPM that there’s “no doubt” that O’Keefe’s accomplices violated the law. Election law expert Rick Hasen, who writes the Election Law Blog, joked in an email to TPM that O’Keefe’s team should “next show how easy it is to rob a bank with a plastic gun. Who in their right mind would risk a felony conviction for this? And who would be able to do this in large enough numbers to (1) affect the outcome of the election and (2) remain undetected?” Hasen wrote.
However, O’Keefe’s video did make a great point - the current system worked. An observant poll watcher caught a man trying to vote using the name of another man who had died 10 days prior:
Someone did, in fact, catch on to the scheme when a man dressed in a suit and tie tried to vote as a dead man known to the poll watcher. The man left before police arrived and said the poll watcher would “soon find out” why he tried to vote under a fake name, the Boston Herald reported Tuesday night.
So, if he commissioned this crime, that might be a violation of his probation - particularly conditions five and nine. O’Keefe’s three year term of federal probation stemming from his attempt to wire-tap Louisiana Sen. Mary Landrieu’s office phones.
After the talk and the Q & A, I hung around with a few other sycophantic crackers to tell James how awesome he was. “You’re, like, my hero, man!” I yelled in his face. Among other problems, Jay Mitchell Huntsman has a volume control problem. “Sorry!” I said. “I blew out my ears when I was in a Hall & Oates cover band. It was worth it, though!”
"That’s…OK" Keefe said, shaking hands and posing for pictures with grateful grandmas. "So you’re a blogger?" he asked, pointing to my credentials.
"YEAH!" I yelled. "I just started a blog called ‘Eagles, Guns & Eagle-Guns’ — at blogspot.com!" I hung out for a few more minutes as the room emptied. Keefe was fiddling with his smart phone.
Breitbarting O’Keefe - this is so goddamn brilliant.
Rightwing activists and propagandists James O’Keefe and Hannah Giles, employees of con-artist and propagandist Andrew Breitbart, may not use the First Amendment as an excuse for breaking the law in California, according to a federal judge’s ruling this week.
Judge M. James Lorenz rejected the defendants’ argument and motion for summary judgment in federal court, as part of the civil lawsuit filed against them by former San Diego ACORN worker Juan Carlos Vera.
Basically, in California, you can’t tape a meeting, etc. if both parties agree it would be confidential. This is what these two did, and the judge said the First Amendment does not allow them to break the law.
A New Jersey special education teacher who risked her life to save school children was suspended for nine days after unintentionally appearing in James O’Keefe’s anti-union “Teachers Unions Gone Wild” video.
In 1997, Alissa Ploshnick received a personal letter from then President Bill Clinton praising her for throwing herself in front of a moving van to protect her students. Ploshnick was hospitalized for broken ribs, a fractured wrist, a badly bruised pelvis, and glass cuts in her eyes.
"I recently heard about your act of heroism and wanted to commend you for your selflessness," Clinton wrote. "True heroes are rare in today’s world. And, all too often, those who are really making a difference in our communities go unnoticed and unrewarded."
James O’Keefe is best known for acting as the ‘pimp’ in an ACORN sting operation. In his latest video, titled “Teachers Unions Gone Wild,” O’Keefe hired a number of people to hang around in a hotel where a New Jersey Education Association conference as taking place and record conversations with teachers.
During the making of the video, Ploshnick was secretly recorded by a man working for O’Keefe while they conversed at an East Brunswick bar. The man working for O’Keefe reportedly bought her drinks and pretended to be hitting on her. At one point, while the two were discussing teacher’s tenure, Ploshnick described an incident in which a teacher called a student the n-word, but was not fired, only demoted.
"All she did, according to our video, is unwittingly blow the whistle on a fellow teacher who called a black student the ‘N’ word," said Christian Hartsock, who worked with O’Keefe on the video. "Basically, she had neither done, nor said anything wrong."
After the video was released, Superintendent Robert Holster claimed the incident described by Ploshnick never occurred and suspended her for nine days for using the n-word.
"I felt like I was raped," Ploshnick said after learning the flirtatious young man was actually part of a campaign to discredit her union.
Journalistic standards require reporters to identify themselves and not surreptitiously record others.
This woman literally threw herself in front of a van to save her students. She expressed outrage at a colleague using the n-word. James O’Keefe is a misanthropic little trust-fund shit with an inflated sense of self-importance. He literally taped people without their consent and, I’m going to make a wild guess, took their statements out of context. Where is the conservative outrage over this teacher’s personal privacy and freedom? She should sue this kid.
Way to discourage future teachers from going into the field and if they do, unionizing for their own protection.
Memo to James O’Keefe: When the people you hire come down on the side of the subject you want to destroy, you’ve gone too far.
